What Does 0.3% THC Actually Mean?

If you’ve shopped for CBD products, you’ve probably seen the phrase: “Contains less than 0.3% THC.” But what does that actually mean?

Most people don’t care about a legal percentage. They want to know how much THC is actually in the product.

The Simple Explanation

The 0.3% THC standard comes from the 2018 Farm Bill. Under that law, hemp is generally defined as cannabis containing no more than 0.3% THC on a dry weight basis.

In practical terms, this standard was designed to allow traditional hemp products, including full spectrum CBD oil, to be legally grown, extracted, and sold.

What 0.3% Means in Full Spectrum CBD Oil

In many full spectrum CBD oils, the amount of THC is very small compared to the amount of CBD.

A helpful way to understand it is this: A full spectrum CBD product with 25 to 30 mg of CBD per serving often contains less than 1 mg of THC. That comparison helps explain what “less than 0.3% THC” often means in a traditional full spectrum CBD product.

It is not usually a large amount of THC. It is a trace amount that naturally occurs in hemp.

Why Full Spectrum Products Contain THC

Full spectrum CBD oil is made from hemp extract that contains CBD along with other naturally occurring hemp compounds. That may include:

  • CBD
  • CBG
  • CBC
  • Other cannabinoids
  • Terpenes
  • Flavonoids
  • Trace amounts of THC

The presence of trace THC is what makes a product full spectrum. Broad spectrum CBD products are different because the THC has been removed.

Why Do Some Hemp Products Contain Much More THC?

This is where the hemp industry became more complicated. The original 2018 Farm Bill was intended to support traditional hemp products, including full spectrum and broad spectrum CBD products.

Over time, extraction companies discovered ways to separate, concentrate, and convert cannabinoids from hemp. That led to intoxicating hemp products such as Delta-8 THC, Delta-10 THC, HHC, high-potency Delta-9 THC products, and other hemp-derived cannabinoids.

In some cases, processors remove much of the CBD from hemp extract, which increases the concentration of THC in what remains. This is part of what many people refer to as the “hemp loophole.” It is how some hemp-derived gummies and other products came to contain much higher amounts of THC than traditional full spectrum CBD oil.

Why This Matters Now

Because intoxicating hemp products became widely available, Congress passed legislation that will remove intoxicating hemp products from the market beginning November 12, 2026.
